Who owned it prior to the sale and if it was taken from a grave then is it not theft? What would happen if i went to a cemetery dug up some graves and removed any jewellery that had been buried with the deceased, would it be mine to keep?

They were checking if the body had corrupted, since that was one of the claims under which he was made a saint. There is I think a great difference between a reverential opening of a sacred relic and digging up any old grave for profit.
