Maybe they are planning to appeal against costs - and the case isn't completely done, because the costs haven't been handed down.

The report says they have been ordered to pay costs. The existence of an appeal wouldn't prevent free reporting and commenting, as their Lordships are supposed to be immune from being influenced by the papers.
