I have the terrible urge to ask you to define harm...I am half way through a blog post on dogging. Hardcore doggers get very excised about how their behaviour causes no harm, I believe no one has the right to inflict their sweaty arse thrusting away on anyone.

The problem with utilitarianism, which seems tobe what your quote bils down to is who decides what is acceptable.

Oh no, they join in too, although there are the more old fashioned peeping tom sort. Of course point out that many of the watching men would 30 years ago been peering through windows and you need to be prepared to make a swift exit. The do no harm thing comes up again there though, if someone is merely watching you through a window are they doing harm? They might argue no.

These Bills owe more to Rousseau and the enlightenment, really, but there are clear libertarian and utilitarian echoes, obviously.
Who decides? The polity decides, by the making of sensible laws, which can be challenged if found to be in error. All power derives from the people and all governance is on their behalf.
